Terms of Service

By accessing or using AItakeoffs.net ("the Platform"), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any part of these terms, you must not use the Platform. These terms apply to all users of the Platform, including subscribers, trial users, and team seat members.

AItakeoffs.net provides software tools that use artificial intelligence to assist with the preparation of construction quantity takeoffs and cost estimates. The Platform processes uploaded PDF plan documents and uses AI vision and language models to identify, count, and measure items shown on those plans. The Platform is a productivity tool only. It is not a licensed engineering, electrical, or mechanical consulting service.

3.1 The AI systems used by this Platform may make errors. Symbol recognition, quantity counting, linear measurements, and cost estimates may be inaccurate, incomplete, or misleading due to plan quality, drawing complexity, symbol ambiguity, scale distortion, or limitations of AI technology. 3.2 You acknowledge that all outputs from the Platform require review and verification by a suitably qualified and experienced estimator or tradesperson before being used in any quotation, tender, contract, or business decision. 3.3 AItakeoffs.net makes no warranty, express or implied, as to the accuracy, completeness, fitness for purpose, or reliability of any output generated by the Platform. 3.4 To the maximum extent permitted by law, AItakeoffs.net and its owners, directors, employees, contractors, and agents shall not be liable for any direct, indirect, incidental, consequential, special, or exemplary damages arising from: • Inaccurate quantity counts or measurements • Missed items or symbols on plans • Incorrect pricing or cost estimates • Under-quoting or over-quoting on any project • Reliance on Platform outputs without independent verification • Any project loss, variation cost, or contractual dispute 3.5 Where liability cannot be excluded by law, the total liability of AItakeoffs.net is limited to the subscription fees paid by you in the three months preceding the claim.

4.1 You are solely responsible for verifying all outputs produced by the Platform before use in any quotation, tender, or project. 4.2 You must ensure that plans uploaded to the Platform are complete, legible, correctly scaled, and represent the current revision of the project. 4.3 You must not rely on Platform outputs as the sole basis for any commercial decision without independent professional review. 4.4 You are responsible for maintaining the security of your account credentials and for all activity conducted under your account. 4.5 You must not upload plans or documents that you do not have the right to use, or that are subject to confidentiality obligations that would prohibit their upload to a third-party platform.

5.1 Access to the Platform requires a paid subscription following the expiry of any free trial period. Subscription fees are charged monthly in advance. 5.2 You may cancel your subscription at any time through the billing portal. Cancellation takes effect at the end of the current billing period. No refunds are issued for partial months. 5.3 We reserve the right to modify subscription pricing with 30 days written notice. Continued use after the notice period constitutes acceptance of the new pricing. 5.4 Team seat subscriptions are billed based on the number of active seats. The account owner is responsible for all charges associated with their account and team.

6.1 The Platform, including its software, design, AI models, and all associated intellectual property, remains the exclusive property of AItakeoffs.net. 6.2 You retain ownership of all documents and plans you upload to the Platform. By uploading content, you grant AItakeoffs.net a limited licence to process that content for the purpose of providing the service. 6.3 Outputs generated by the Platform are provided to you for your use in connection with the service. You may not sublicense, resell, or redistribute Platform outputs.

7.1 We collect and process personal data as described in our Privacy Policy. By using the Platform you consent to such processing. 7.2 Uploaded plan documents are processed to provide the service and are not shared with third parties for commercial purposes. Documents may be retained to improve AI accuracy. 7.3 We implement reasonable technical and organisational measures to protect your data, but cannot guarantee absolute security.

You must not use the Platform to: • Upload illegal, infringing, or malicious content • Attempt to reverse-engineer, scrape, or copy the AI models or software • Share account credentials across organisations (team seats are required for multi-user access) • Use the Platform in any way that could damage or impair its operation Violation of these terms may result in immediate account suspension without refund.

We reserve the right to suspend or terminate your account at any time for breach of these terms, non-payment, or misuse of the Platform. You may terminate your account at any time through the settings page. Upon termination, your access to the Platform will cease. We may retain your data for a period following termination as required by law or for legitimate business purposes.

These terms are governed by the laws of Queensland, Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of Queensland, Australia. If any provision of these terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

We may update these terms from time to time. We will notify you of material changes by email or through the Platform. Continued use of the Platform after changes are posted constitutes acceptance of the revised terms.
